Agreement to Terms
These Terms and Conditions ("Terms") govern your use of the Get Clinic Growth website and services. By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our website or use our services.
Services Description
Get Clinic Growth provides digital marketing services specifically for medical and aesthetic clinics, including but not limited to:
- Google Ads campaign management and optimization
- Facebook and Instagram advertising
- Lead generation campaigns
- Landing page design and development
- Marketing strategy consultation
The specific scope of services will be defined in a separate service agreement between Get Clinic Growth and the client.
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your clinic and services.
- Ensure all content and claims used in advertising comply with applicable healthcare advertising regulations.
- Respond to inquiries and requests in a timely manner.
- Provide necessary access to advertising accounts and platforms.
- Pay for services according to the agreed payment terms.
- Comply with all applicable laws and regulations governing healthcare marketing in your jurisdiction.
Healthcare Advertising Compliance
You acknowledge that healthcare and medical advertising is subject to specific regulations. You agree to:
- Ensure all claims made in advertisements are truthful and can be substantiated.
- Comply with regulations set by relevant medical boards and advertising standards authorities.
- Not make misleading claims about treatment outcomes or guarantees.
- Obtain necessary approvals for any testimonials or before/after content.
- Take responsibility for the accuracy of all medical information in your advertising.
While we assist with campaign creation, ultimate responsibility for regulatory compliance rests with the clinic.
Payment Terms
Payment terms will be specified in your service agreement. Generally:
- Management fees are billed monthly in advance.
- Advertising spend is separate from management fees and is paid directly to advertising platforms.
- Invoices are due within 7 days of receipt unless otherwise agreed.
- Late payments may result in service suspension and may incur additional charges.
- All fees are non-refundable unless otherwise specified.
Performance and Results
While we strive to deliver excellent results, we cannot guarantee specific outcomes. Marketing results depend on many factors including:
- Market conditions and competition
- Your clinic's reputation and reviews
- Service pricing and offerings
- Response time to leads
- Quality of patient experience
Any projections or estimates provided are based on our experience and available data but are not guarantees of future performance.
Intellectual Property
Our Materials: All marketing materials, strategies, templates, and methodologies developed by Get Clinic Growth remain our intellectual property. You are granted a license to use these materials for your clinic's marketing during our engagement.
Your Content: You retain ownership of your clinic's logos, images, and proprietary content. By providing content to us, you grant us permission to use it in marketing campaigns on your behalf.
Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information shared during our engagement. This includes:
- Business strategies and marketing plans
- Financial information and pricing
- Patient data and lead information
- Campaign performance data
This obligation survives termination of our agreement.
Limitation of Liability
To the maximum extent permitted by law:
- Get Clinic Growth shall not be liable for any indirect, incidental, special, or consequential damages.
- Our total liability shall not exceed the fees paid to us in the three months preceding the claim.
- We are not responsible for actions taken by third-party platforms (Google, Facebook, etc.) that may affect your campaigns.
- We are not liable for any regulatory penalties arising from your advertising content or claims.
Indemnification
You agree to indemnify and hold harmless Get Clinic Growth, its officers, employees, and agents from any claims, damages, or expenses arising from:
- Your breach of these Terms
- Your violation of any law or regulation
- Any claims related to your clinic's services or patient care
- Any false or misleading claims in your advertising content
Termination
Either party may terminate services with 30 days written notice. Upon termination:
- All outstanding fees become immediately due.
- We will transfer ownership of advertising accounts (if created by us) upon request and payment of final invoices.
- Confidentiality obligations continue to apply.
- We may retain copies of campaign data for our records.
Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved as follows:
- Negotiation: Parties will first attempt to resolve disputes through good faith negotiation.
- Mediation: If negotiation fails, parties agree to attempt mediation before pursuing legal action.
- Jurisdiction: These Terms are governed by the laws of India, and any legal proceedings shall be conducted in courts located in New Delhi.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify clients of any material changes. Continued use of our services after changes constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with any service agreement, constitute the entire agreement between you and Get Clinic Growth regarding our services and supersede any prior agreements.
